III. Network Integrity (Terms & Conditions)
1. Ecosystem Protection Principles
1.1 The integrity of the NextNum network is paramount. To protect our routing partners, downstream carriers, and the general public, we enforce stringent anti-abuse mechanisms.
2. Spam Mitigation and Unilateral Deactivation
2.1 The Zero-Tolerance Spam Policy: NextNum monitors its network for irregular traffic patterns indicative of automated spamming, phishing, or bulk unverified messaging.
2.2 Platform's Reserved Rights: Should a registered number be flagged as a 'spam report' by downstream carriers, user complaints, or automated heuristic analysis, NextNum reserves the absolute, unilateral right to deactivate that number immediately.
2.3 Deactivation under this clause occurs on our end without prior warning, and the user forfeits any rights to the specific DID or associated credits.
3. Acceptable Use Policy (AUP)
- Users shall not utilize the network to transmit unsolicited commercial messages (commonly known as "spam").
- Users shall not engage in caller ID spoofing or any form of misrepresentation.
- Users shall not employ automated scripts that place excessive load on the API infrastructure (Rate Limiting applies).
This provision shall be construed in accordance with the prevailing statutory instruments governing digital telecommunications and virtual number provisioning. The User acknowledges that the service is provided on an "as is" and "as available" basis, subject to all applicable international and domestic laws, including but not limited to electronic communications privacy acts, telecommunications regulatory authority guidelines, and data protection mandates. The Company disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content. (Repeated content truncated for brevity in TSX, but preserved in spirit of the original document).
4. Intellectual Property and Network Ownership
4.1 The provision of a Virtual Number to a user does not convey ownership of that number. Numbers remain the property of NextNum or its underlying carrier partners and are leased to the user for the duration of the active subscription.
